Please, read this page before using post kulture. It tells you everything about how we do business, what your rights are as a customer are and loads more. We’ve last updated this page on the 24th of May, 2018.

General

We are registered in England and Wales under company number 08618531 and our office is registered at 38 Kingsland Road, Post Kulture office 4, Perseverance Works, E2 8DD, London.
We may update these terms from time to time. The latest version is always the one on our website. Everytime you use Post Kulture after any updates on our terms, you automatically agree to these.
With any major changes, Post Kulture will always notify you, so you’re aware of these chances.
Our engineers are working around the clock to keep Post Kulture’s engine running on all devices. That being said, we can’t guarantee that everything’s always flawless. If you spot a bug, or something isn’t working, please tell us by emailing saysomething@postkulture.com
Third-party retailers
Post Kulture acts as a venue and marketplace for third party retailers. Post Kulture compiles, curates and displays these items for you to discover. Post Kulture does not provide or sell these items and is not party to any transaction you may make with a seller.
This means that any contractual obligations arising out of a transaction using Post Kulture are the responsibility of you and the seller, not Post Kulture. Post Kulture does not have any responsibility for, or liability related to, any third-party products listed on the Post Kulture.
You should direct any questions, complaints or claims related to any third-party products to the relevant seller.
Accessing Post Kulture
Post Kulture will do its best to make sure that your experience is uninterrupted and error free, although we cannot guarantee this. Access to Post Kulture is permitted on a temporary basis, and we reserve the right to withdraw or amend things without notice and we are not liable if Post Kulture is unavailable at any time or for any period.
If we need to suspend or restrict access to Post Kulture or a particular piece content, we will do our best to minimise any disruption to you. Due to items selling out, we may change or remove products from Post Kulture without notice. We have the right to disable any username or password if, in our opinion, you have failed to comply with any of the provisions of our terms and conditions. When accessing Post Kulture over your mobile network, you will be using your data allowance.
Post Kulture is not responsible for any charges made whilst browsing Post Kulture. You are also responsible for ensuring that all persons who access our service through your internet connection are aware of these terms, and that they comply with them.
The legal rights (including our intellectual property rights) in the service are owned by Post Kulture Limited. Any content on Post Kulture is owned by us or licensed to us by third parties. All products from third-party retailers are owned, controlled or licensed by the sellers.
Where we provide links from Post Kulture to other sites, this will be for information purposes only or to enable you to transact directly with a seller. Post Kulture is not responsible for the content on those sites.
Acceptable use of the Service
You may use Post Kulture in the way that is described in these terms & conditions. You may not use Post Kulture’s trademarks, logos or other intellectual property without our written permission. You can’t use Post Kulture for any illegal purpose or in any way that: (i) causes damage or harm to us or any seller or any other user; (ii) breaches any applicable local, national or international law or regulation; (iii) is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect; (iv) transmits, or procures the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam); or (v) knowingly transmits any data, sends or uploads any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
You must not access without permission, modify, interfere, damage or disrupt Post Kulture; any equipment or network used in the provision of the service; any software used in the provision of Post Kulture; or any equipment or network or software owned or used by a third party.
You are responsible for compliance with local law and regulation when accessing the Service.
Post Kulture will take any action it thinks is necessary to protect ourselves and our users. This may include suspending, restricting or terminating your Post Kulture account and access to the service.
You understand that if you breach these terms, then we may decide to ban you.
Our legal obligations
If Post Kulture does not comply with its obligations to you under these terms, Post Kulture is responsible for any loss or damage that you suffer which is a “foreseeable result” of such breach or negligence. Loss or damage is a foreseeable result if it is an obvious consequence of our failure to comply with our terms. Regarding any third-party purchases, Post Kulture (including our employees, agents and group companies) is not responsible for any claims, demands or damages.
As a consumer, you are entitled to various statutory warranties (including, for example, that any service is carried out with reasonable skill and care, and any product purchased is of satisfactory quality). Nothing in these terms shall have the effect of excluding or limiting those implied statutory warranties which may not be excluded or limited under applicable law.
Nothing in these terms limits or excludes our liability for: (i) death or personal injury caused by our negligence; (ii) fraudulent misrepresentation; or (iii) any other liability that cannot be excluded by law.
Other important terms
We may terminate these terms at any time if: (a) you breach these terms; (b) you become or threaten to become insolvent or bankrupt; or (c) we decide to suspend or terminate Post Kulture or ICE Ltd.
These terms do not affect your legal rights. For more information about your legal rights in relation to any item purchased that is faulty or is not as described, you may wish to visit your local Citizens Advice Bureau or Trading Standards Office.
You agree to compensate and reimburse Post Kulture fully for any claims or legal proceedings which are brought against Post Kulture as a result of your breach of these Terms or misuse of the service.
No other person has any rights to enforce any of these Terms.
You may not transfer your rights or obligations under these Terms to anyone else without our written permission. We may transfer our rights and obligations to another party, but this will not affect your rights or our obligations to you under these Terms.
Each of the paragraphs in these Terms operates separately. If any courts or relevant authority decide that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
The User’s use of the Service, including any dispute or claim arising out of or in connection with it, will be governed by English law. Post Kulture and each User both agree that the courts of England and Wales shall have the non-exclusive ju risdiction.
